Expert Witness Services
Independent technical opinion and clear explanation of complex evidence.
Independent expert assistance
Expert evidence can help a court or other decision-maker understand technical matters that fall outside ordinary knowledge. Depending on the instruction and the expert’s field, the work may include reviewing records and other material, identifying relevant issues, conducting or assessing examinations, preparing a written report and explaining findings.
Evidence-led opinions
An expert opinion should be based on the material available and the questions within the agreed scope. The reasoning behind the opinion should be explained clearly, including the facts and assumptions relied upon, the significance of the findings and any limitations or areas of uncertainty.
Where the evidence does not support a firm conclusion, that should be made clear. An expert’s role is to provide an independent and objective opinion, not to act as an advocate for the party instructing them.
Reports that are clear and useful
A well-prepared report sets out the expert’s relevant expertise, the instructions received, the material considered, the work undertaken, the findings and the reasoning leading to the conclusions. It should use clear language and distinguish established facts from interpretation or opinion.
Working to the requirements of the case
The scope, timetable, format of the report and any further assistance required should be agreed at the outset. The applicable court rules, directions and professional requirements depend on the jurisdiction and type of proceedings and must be considered for each instruction.
